Section 1: Services

TekCapitol, Inc. ("TekCapitol") provides AI workflow readiness products and services under the Kyklos360® methodology. We offer the following:

Kyklos360 KAssess (self-serve)

AI agent workflow readiness assessment at tekcapitol.com/kyklos/. No login required to start. One AI agent workflow free per company (work-email domain, lifetime) after OTP verification with a work email (no Gmail, Yahoo, Hotmail, or Outlook.com). Includes branded PDF, KFix queue, remediation workspace, road map, governance spec, and 30-minute findings review call. No payment required for the first workflow.

Kyklos360 Additional Workflows

Additional workflows or re-assessments after your company's free workflow is used. Same full deliverable as the free workflow. Pricing provided on request via email to info@tekcapitol.com; invoiced separately upon agreement.

TekCapitol Guided Remediation, $25,000 or $50,000

Optional services to help execute the Kyklos360 roadmap, stakeholder discovery, facilitation, and implementation support for one workflow. Scope, deliverables, and timeline confirmed in a scoping call and documented in a Statement of Work before any payment is requested. Not a second assessment product.

Section 2: Payment

All engagements are invoiced. Payment is due within 7 days of invoice date unless otherwise agreed in writing. TekCapitol accepts payment via ACH, wire transfer, or credit card through our invoicing provider.

No payment is collected through this website.

Section 3: No Refund Policy

All sales are final. No refunds are provided after payment.

We encourage all prospective buyers to complete KAssess and use their company's one free workflow before purchasing additional workflows or guided remediation services. The free workflow includes the same full deliverable as paid assessments.

Section 4: Intellectual Property

The Kyklos360® methodology, scoring framework, and platform are proprietary to TekCapitol, Inc. and protected by applicable intellectual property laws.

The assessment report generated from your workflow data is your property. You may use it internally and share it with your team, advisors, and board. You may not resell or sublicense assessment reports.

Section 5: AI Processing

Kyklos360 uses large language models (LLMs) to analyze workflow descriptions and schema artifacts you provide.

AI Providers

Your data is processed by one or more of the following AI providers:

· Google LLC: Gemini family of models
· Anthropic, PBC: Claude family of models
· OpenAI, Inc. GPT family of models

The specific model used may vary based on task complexity and performance requirements. Specific model versions may change without notice. The providers listed above will not change without updating this disclosure.

We do not use models that retain customer data for training purposes.

What Is Sent to AI Providers

✓ Platform selections (e.g. Salesforce, SAP, Epic)
✓ Agent type (e.g. Claims Triage Agent)
✓ Schema metadata you upload: column names · data types · null counts · row counts
✓ Your company name (for report cover only)
What Is Never Sent to AI Providers
✗ Raw database records or customer data
✗ Personally identifiable information (PII)
✗ Protected health information (PHI)
✗ Financial transaction records
✗ Social Security numbers or ID numbers
✗ Passwords, API keys, or credentials
✗ Proprietary source code

Your data is processed solely to generate your Kyklos360 assessment report. Assessment data is deleted 90 days after your assessment date.

For Regulated Industries

If your workflow involves patient data (HIPAA), financial services (FINRA · SEC), debt collection (CFPB), EU customer data (GDPR), or federal government data (FedRAMP), contact us before uploading any workflow or schema data.

Section 6: Limitation of Liability

Kyklos360 identifies data readiness gaps based on information you provide. TekCapitol does not guarantee that resolving identified gaps will result in successful AI agent deployment or any specific business outcome.

TekCapitol's total liability arising from any engagement is limited to the amount paid by the client for that specific engagement.

TekCapitol is not liable for indirect, incidental, or consequential damages of any kind.

Section 7: Governing Law

These Terms are governed by the laws of the State of California. Any disputes will be resolved in Santa Clara County, California.
