Terms of Use

1. Agreement

By accessing tekcapitol.com or using TekCapitol services described below, you agree to these Terms of Use. If you are using services on behalf of an organization, you represent that you have authority to bind that organization.

2. Services covered

These Terms cover public website content and the following product surfaces (as made available):

· Real-Time AI Action Assurance marketing site and documentation

· Assurance Lab (public staging demo)

· Check Write™ Sandbox

· Check Write™ API and MCP endpoints

· Developer key / OTP signup

· TC Protect™ evaluation and runtime services (as contracted)

· TC360® methodology services including TC Diagnose™, TC Fix™, sample reports, and guided remediation engagements

· Pilot / evaluation programs (including VPC pilots) as separately scoped

Paid commercial terms, fees, and SLAs for production runtime or professional services are set in an order form, statement of work, or other written agreement. Public pages that mention pricing are informational and may change.

3. Demos, synthetic data, and no production reliance

The Assurance Lab, sandbox, sample reports, and similar demos may use synthetic data, demo conditions, and mixed LIVE / SIM evidence. They are for evaluation and education.

Do not rely on public demos as a production control plane. Production use of Check Write™ / TC Protect™ requires an appropriate deployment and agreement. TekCapitol does not execute your destination write; your systems remain responsible for execution after a decision.

4. User-submitted content

You are responsible for content you submit (workflow text, schemas, form fields, API payloads). Do not submit secrets, passwords, production credentials, or unlawful content into public demos. You grant TekCapitol a limited license to process submitted content solely to provide the requested service.

5. Acceptable use

You may not: attempt unauthorized access; disrupt services; use demos to attack third-party systems; scrape in a way that degrades service; reverse engineer except as allowed by law; or use the services to violate law or third-party rights.

6. Third-party systems

Integrations with Salesforce, ServiceNow, Databricks, Snowflake, SAP, Okta, and similar systems are optional and customer-configured. Those vendors’ terms apply to your use of their products. Mentions of third-party brands do not imply partnership or endorsement unless expressly stated.

7. Developer keys and APIs

API keys and OTP access are personal/organizational credentials. Keep them confidential. We may revoke keys for abuse, security risk, or inactivity. Rate limits and fair-use controls may apply.

8. Intellectual property and trademarks

TekCapitol, Real-Time AI Action Assurance, Check Write™, Trace™, TC Diagnose™, TC Fix™, TC Protect™, and TC360® are trademarks of TekCapitol, Inc. Website content, software, and methodology materials are owned by TekCapitol or its licensors. Assessment reports generated from your inputs are yours to use internally as described in your engagement; you may not resell TekCapitol methodology materials.

9. Availability

Public website and demo surfaces are provided “as available.” We may modify, suspend, or discontinue features. Production availability commitments, if any, appear only in a written customer agreement.

10. Disclaimers

EXCEPT AS EXPRESSLY AGREED IN WRITING, SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TEKCAPITOL DOES NOT WARRANT THAT DEMOS OR EVALUATIONS WILL BE ERROR-FREE OR MEET YOUR COMPLIANCE OBLIGATIONS. FRAMEWORK MAPPING IS NOT CERTIFICATION.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEKCAPITOL’S TOTAL LIABILITY ARISING FROM USE OF THE PUBLIC WEBSITE AND UNPAID DEMO SURFACES IS LIMITED TO USD $100. FOR PAID SERVICES, LIABILITY IS LIMITED TO THE AMOUNTS PAID TO TEKCAPITOL FOR THE ENGAGEMENT GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, UNLESS A SIGNED AGREEMENT STATES OTHERWISE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Privacy

Personal data is handled as described in our Privacy Policy and Data & Confidentiality page.

13. Governing law

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Exclusive venue for disputes arising from these Terms is the state or federal courts in Santa Clara County, California, unless a signed customer agreement specifies otherwise.

14. Changes

We may update these Terms by posting a new effective date on this page. Continued use of the public site after changes constitutes acceptance of the updated Terms for that use. Customer contracts control over these Terms for conflicting paid-service terms.
